General Terms and Conditions (GTC)

1.  TREATMENT CONTRACT
  1. The terms and conditions apply to the business relationships of all patients of Dr. David KARL (AugenZentrum Kaisermühlen), unless otherwise agreed in writing between the contracting parties.

  2. The treatment contract is concluded when the patient accepts the general offer of the practice, makes an appointment and contacts Dr. David KARL turns.

  3. Patients must fill out a medical history form before each appointment. The information and personal data are subject to medical confidentiality and are treated with absolute confidentiality.

  4. The signature on the anamnesis form confirms that the terms and conditions have been read, understood and accepted.

  5. Underage patients are represented by their legal representatives.

  6. If the patient does not show up for the agreed appointment without an excuse, a cancellation fee can be charged. This payment obligation does not apply if the appointment is at least 24 hours was previously cancelled.

  7. Austrian law applies: the place of jurisdiction is Vienna.
     

2.  FEES AND PAYMENT
  1. As a rule, the current fee rates set out on the  website (under AugenArzt22.at) apply.

  2. The cost of a basic ophthalmological examination is €160.00 per patient. Additional examinations are agreed and charged separately. Payment must be made immediately after the treatment by debit card, credit card or in cash.
     

3.  TREATMENT SUCCESS AND LIABILITY
  1. Treatments are offered to the best of our knowledge, but success cannot be guaranteed. This also applies to surgical and aesthetic procedures.

  2. Both parties endeavor to ensure that the treatment is successful as soon as possible.

  3. AugenZentrum Kaisermühlen assumes no liability whatsoever for items brought along.
     

4.  THIRD PARTY RELATIONSHIPS AND AGENTS
  1. The practice is entitled to use third parties to fulfill the obligations arising from the treatment contract.

  2. Will Dr David KARL is represented by another doctor, the treatment contract only applies between the representative and the patient. dr David KARL assumes no liability for any misconduct by third parties.
     

5.  THIRD PARTY REFUND
  1. AugenZentrum Kaisermühlen is an optional doctor's surgery, ie there is no contract for direct billing with the statutory health insurance companies.

  2. Each patient is responsible for any reimbursement and approval procedures. The ordination can help with the application.

  3. The liability of Dr. David KARL is limited to the amount to be paid by the liability insurance, unless intent or gross negligence is responsible.
     

6.  CONFIDENTIALITY

  2. Patient data will be treated confidentially and information will only be given with the express consent of the patient, unless disclosure is mandatory due to legal regulations or a court order.

In order to use the online appointment system, it is necessary to create a user account once. With the login data you can log in again and again to manage your appointments. The use of the service is for you free of charge.


We will treat the data you provide as strictly confidential. We will not pass on any personal data without your express consent, unless we are legally obliged to do so. However, we would like to point out that when data is transmitted over the Internet, it is always possible for third parties to take note of or falsify your data.

  1. We process your personal data in accordance with GDPR. The data categories can be found in our current anamnesis form.

  2. The purpose of this data processing is on the one hand medical diagnostics and treatment in the health sector and on the other hand the fulfillment of the legal documentation obligation.

  3. We only pass on your data to the following recipients: laboratory, pathological institute, referrer, family doctor, hospitals.

  4. If necessary, data is also transmitted due to legal obligations to authorities or courts.

  5. In principle, you have the right to information, correction, restriction, data transferability and objection. For this, please contact us. As a rule, you do not have the right to delete your data from the patient administration due to the legal documentation obligation.

If you send us an e-mail request, personal data will be processed. The legal basis for processing is Article 6 Paragraph 1 Letter b GDPR for the fulfillment of a contract or for the implementation of pre-contractual measures. In the event that a contract is concluded, separate information is provided in accordance with Article 13 GDPR. If no contract is concluded, the data will be deleted at the end of the calendar year following the conclusion of the negotiations.
